Overview

These Terms of Service (“Terms”) govern your access to and use of the Fullsend application (“the Application”) operated by Darkblue, LLC (“Darkblue,” “we,” “us,” or “our”). By accessing or using Fullsend, you agree to be bound by these Terms. If you do not agree, you may not access or use the Application.

Fullsend is a hosted text-message paging and communication service provided to contracting organizations. Users may access the system under accounts authorized by those organizations and administered by Darkblue.

Eligibility and Use

You must be at least 18 years old and authorized by a contracting organization to use Fullsend. You agree to use the Application only for lawful purposes and in compliance with all applicable laws, regulations, and these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If you believe your account has been compromised, you must notify Darkblue immediately.

Acceptable Use

Users agree to not:

  • Use Fullsend to send unlawful, abusive, harassing, threatening, defamatory, or otherwise objectionable content;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Application or its systems;
  • Use the Application for unsolicited or bulk messaging outside the scope of the contracting organization’s intended use;
  • Introduce malware or perform security testing without express written permission; or
  • Attempt to reverse engineer, copy, or modify any part of the Application.
Violations of these provisions may result in suspension or termination of access, at Darkblue’s sole discretion.

Data Ownership and Usage

All information entered into or generated by the Application—including messages, recipients, senders, timestamps, and logs—is retained indefinitely and owned by Darkblue, LLC.

Darkblue may disclose such data, in full or in part, to the contracting organization upon a valid and reasonable request, and may also disclose data where required by law, court order, or government authority.

Users acknowledge that they have no ownership, deletion, or modification rights over stored data except as may be required by applicable law.

Service Availability

Fullsend is provided on an “as-is” and “as-available” basis. While Darkblue strives to ensure reliability and uptime, we make no guarantees regarding availability, performance, or error-free operation.

Maintenance, updates, outages, or third-party issues may temporarily affect accessibility.

Darkblue may modify, suspend, or discontinue the Application at any time without notice or liability.

Security and Authentication

Access to Fullsend requires authentication. Currently, authentication is provided via username and password; other methods such as API keys or single sign-on (SSO) may be added in the future.

Data is encrypted in transit but not encrypted at rest. Users acknowledge and accept these limitations.

Darkblue employs reasonable administrative and technical safeguards but cannot guarantee absolute security.

Third-Party Services

Fullsend may rely on third-party service providers (for example, for SMS transmission, hosting, or other infrastructure).

Darkblue does not control and is not responsible for the practices or reliability of these external services.

Use of the Application constitutes consent to necessary data processing by such providers to enable functionality.

Intellectual Property and Open Source Licensing

Fullsend is developed and maintained by Darkblue, LLC and distributed as open-source software. The source code, documentation, and related materials are made publicly available under the open-source license specified in the project’s repository (the “License”).

Use of the publicly released Fullsend source code is governed by that License, which grants you certain rights to use, modify, and distribute the software in accordance with its terms. Nothing in these Terms is intended to limit or modify your rights under the applicable open-source license.

However, the hosted instance of Fullsend operated by Darkblue, LLC—including its configuration, data, databases, and infrastructure—remains the exclusive property of Darkblue and is not licensed for self-hosting or duplication except as permitted by the open-source License. Any trademarks, trade names, or branding associated with Fullsend remain the property of Darkblue and may not be used without prior written consent.

Disclaimers

Fullsend is provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

Darkblue does not guarantee that messages will always be delivered, that logs will be error-free, or that the Application will meet every operational requirement of contracting organizations.

Limitation of Liability

To the fullest extent permitted by law, Darkblue, LLC and its members, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Application, including but not limited to loss of data, loss of communications, or system downtime, even if advised of the possibility of such damages.

In all cases, Darkblue’s total cumulative liability shall not exceed the amount paid by the contracting organization for the specific period in which the claim arose, if any.

Indemnification

You agree to indemnify and hold harmless Darkblue, LLC, its officers, members, employees, and affiliates from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Application;
  • Your violation of these Terms; or
  • Your violation of any rights of another person or entity.

Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute or claim shall be brought exclusively in the state or federal courts located within Massachusetts, and you consent to the personal jurisdiction of those courts.

Termination

Darkblue may suspend or terminate your access to the Application at any time, with or without notice, for conduct that it believes violates these Terms or is otherwise harmful to its interests, the system, or other users. Upon termination, your right to access the Application immediately ceases.

Data retained in the system remains the property of Darkblue and will not be deleted or transferred except as provided in the Privacy Policy.

Changes to These Terms

We may revise these Terms from time to time. Updated Terms take effect immediately upon posting to the Fullsend website or application. Your continued use of the Application after changes are posted constitutes acceptance of the new Terms.
